Terms and conditions

Purpose

These terms apply to the Maniaque services offered to businesses: building a custom digital tool, then evolving and maintaining it through a subscription.

In Marseille, the provider is Jean-Samuel Jéquier, sole trader operating under the trade name Maniaque (SIRET: 894 000 348 00017, 79 avenue de la Fourragère, 13012 Marseille, France). In the other cities, the provider is the Maniaque network specialist named in the proposal sent after the audit.

Audit

The audit lasts 45 minutes. It is free and commits you to nothing. You then receive a page describing the problem, what the first version would do, the total monthly cost, and our opinion on whether it's worth it. A non-disclosure agreement can be signed from the audit onwards.

Scoping and first version

The first version is a working version of the tool that you or your teams can use day to day. Its minimum features, screens, data and hosting are defined together during scoping, and approved in writing.

It is delivered in 2 to 8 weeks, depending on the scope. The clock starts when the scope is approved.

Plans and prices

Prices are those of the selected city, excluding VAT. Two plans are offered:

Paid first version: ZAR 50,000 excl. VAT for the first version, then a subscription of ZAR 9,900 excl. VAT per month from its delivery, with no minimum term.

Free first version: a subscription of ZAR 9,900 excl. VAT per month from day one, with a 6-month minimum term.

Payment

The first version is paid half on order, half on go-live. The subscription is charged by direct debit at the start of each month.

Term and cancellation

Outside the minimum term, the subscription can be cancelled any month. You can also switch to a maintenance-only plan, at ZAR 990 excl. VAT per month, hosting not included: your tool stays maintained, with no new requests.

Requests and timing

Every message gets a reply within 24 business hours. Requests go through your dashboard, where you change the roadmap in real time, or by message.

One feature is built at a time, with a delivery date announced in advance; tweaks move forward alongside. A tweak changes something that already exists (a label, a colour, a column, a calculation); a feature adds something new (a screen, an import, an automatic email, a connection to other software).

You name someone available about an hour a week to test and approve what is delivered.

Guarantee

If the delivery date announced for a feature is missed, the next month's subscription is half price.

Hosting and pay-per-use services

The tool is hosted by us or by you. If we host it, hosting costs are included in the subscription up to ZAR 1,000 excl. VAT per month.

Pay-per-use services (text messages, high-volume emails, artificial intelligence built into the tool, Apple and Android developer accounts…) are passed on at cost, with no markup.

Ownership of code and data

Your tool's code and your data belong to you from day one. If you stop, we hand over the code and the database, or help you install them on your side.

Confidentiality and continuity

Your data and the way you work remain confidential. If your contact is away, another Maniaque network specialist can step in on your tool in an emergency.
